TERMS AND CONDITIONS FOR HEARTH CARD USERS
PREAMBLE
These Terms and Conditions define the terms of the agreement between Hearth S.r.l. (hereinafter "Hearth") and the holders of a Hearth Card subscription (hereinafter "Users"). This agreement governs the use of discounts, gifts, and exclusive benefits that participating businesses (hereinafter "Activities") offer to Users, with the aim of promoting quality cultural experiences and encouraging purchases from Activities.
1. SUBJECT OF THE TERMS AND CONDITIONS
By subscribing to a Hearth Card, the User acquires the right to access a range of discounts, gifts, and exclusive benefits offered by the participating Activities. These benefits, reserved only for holders of an active subscription, may include, but are not limited to, price reductions on products and services, promotional gifts, privileged access to events and special initiatives organized by the Activities, and other advantages that enhance the User's travel experience.
2. SUBSCRIPTION VALIDITY
2.1 Duration:
The Hearth Card is valid for one year from the activation date. The activation date corresponds to the day the User completes the registration and payment process for the subscription.
2.2 Ownership:
The subscription is strictly personal and cannot be transferred, assigned, or sold to third parties. Only the subscription holder is entitled to the benefits and advantages associated with the Hearth Card.
2.3 Cumulability:
The subscription is not combinable with other promotions or special offers, unless otherwise specifically indicated by the participating Activities.
2.4 Validation:
Where required by the participating Activity, the User must present their Hearth Card, along with a valid identity document, when requesting discounts, gifts, and benefits.
3. USE OF BENEFITS
3.1 Validity of benefits:
Discounts, gifts, and exclusive benefits are reserved solely for Users with an active and valid Hearth Card subscription.
3.2 Duration of benefits:
Users can take advantage of the offers without limitations on the frequency of use, unless otherwise communicated exclusively by Hearth S.r.l. Any restrictions on the use of the offers will be clearly specified by Hearth S.r.l. and promptly communicated to Users.
4. CONDITIONS OF DISCOUNTS AND GIFTS
4.1 Minimum Discount Value:
The minimum discount value offered to Users is 10% off the total purchase made at participating Activities. This discount applies to the list price of the products or services purchased, unless otherwise specifically communicated by Hearth S.r.l.
4.2 Types of Gifts:
Gifts reserved for Users may include, but are not limited to, product tastings, additional benefits, small gifts, or free services. Gifts must be of value comparable to the minimum discount provided and must offer a tangible benefit to the User, in line with Hearth S.r.l.'s commitment to promoting superior quality and cultural enrichment experiences.
4.3 Minimum Spending Amount:
Discounts and gifts may be subject to a minimum spending amount at the participating Activity. This minimum spending amount will be established by the individual Activities and communicated by Hearth S.r.l. to Users. Hearth S.r.l. is committed to ensuring that these conditions are clear and transparent and communicated in advance to Users to avoid any misunderstandings.
4.4 Limitations and Exclusions:
Some products or services may be excluded from promotions at the discretion of the participating Activities. These exclusions will be clearly indicated and communicated to Users by Hearth S.r.l. Promotions are not combinable with other ongoing offers, unless expressly stated otherwise.
4.5 Application Methods:
To take advantage of discounts and gifts, the User must present a valid Hearth Card at the time of purchase and, if requested, a valid identity document. Discounts and gifts cannot be applied retroactively to purchases made before the presentation of the Hearth Card.
4.6 Validity of Offers:
Discounts and gifts are valid only at participating Activities that are part of the Hearth Card program. Hearth S.r.l. will provide an updated list of participating Activities on its website or through other official communication channels.
5. APPLICATION OF DISCOUNTS AND GIFTS
5.1 Validity for Active Users:
Discounts and gifts are recognized only for Users with an active Hearth Card subscription. The subscription must be valid at the time of purchase or enjoyment of benefits at the participating Activities.
5.2 Application in Group Contexts:
In group contexts, Users can choose how to apply the discounts. Discounts can be applied to the entire amount of the group's expense or exclusively to the portion of the expense attributable to the User with an active subscription, according to the User's expressed preference. This flexibility is intended to ensure that Users can maximize the benefits of the Hearth Card according to their specific needs.
5.3 Superior Quality Treatment:
Participating Activities commit to reserving a higher quality treatment for Users compared to non-subscribed customers. This commitment includes, but is not limited to:
- Exclusive Experiences: Providing access to events, tastings, presentations, or other exclusive initiatives reserved for Hearth Card Users.
- Service Quality: Ensuring that service standards are high, guaranteeing an overall superior experience.
5.4 Transparency and Communication:
Participating Activities commit to clearly communicating to Users any specific conditions related to discounts and gifts, including any minimum spending amounts, product or service limitations, and offer validity periods. This communication must occur through Hearth S.r.l.'s official channels to ensure transparency and consistency of information.
5.5 Compliance with Conditions:
Participating Activities must fully comply with the conditions of discounts and gifts as established by Hearth S.r.l. Any changes or updates to the conditions must be approved by Hearth S.r.l. and communicated to Users with adequate notice.
5.6 Resolution of Discrepancies:
Hearth S.r.l. will not act as a direct mediator in disputes related to the application of discounts and gifts. However, based on reports received from Users, Hearth will assess the circumstances and may take appropriate action against participating Activities to ensure compliance with the agreements. This procedure aims to maintain high standards of quality and satisfaction for Users.
6. MODIFICATIONS AND WARRANTIES
6.1 Updating and Amending Terms:
Participating Activities have the right to update or modify the terms related to discounts, gifts, and benefits offered to Users. However, such changes must be communicated to Hearth S.r.l. with at least 7 working days' notice. This communication must be made through a dedicated form provided by Hearth S.r.l. and must include specific details about the proposed changes, the reasons behind such changes, and the effective date. Hearth S.r.l. commits to promptly informing Users of the changes through its official channels.
6.2 Prohibition of Omission of Discounts or Gifts:
It is strictly forbidden for participating Activities to omit the application of discounts, gifts, or benefits without valid reason. In case of issues preventing the application of discounts or gifts, the Activity must promptly communicate with Hearth S.r.l. providing a detailed explanation of the circumstances. The Activity is required to cooperate with Hearth S.r.l. to find an adequate solution and ensure that Users can continue to enjoy the promised benefits. This provision is essential to maintain Users' trust and ensure the consistency and reliability of the Hearth Card program.
6.3 Evaluation of User Reports:
Hearth S.r.l. will closely monitor reports received from Users regarding any service disruptions or failure to apply discounts and gifts. Based on the reports, Hearth S.r.l. will evaluate the appropriate actions to be taken against participating Activities that do not comply with the established agreements. Such actions may include, but are not limited to, formal warnings, temporary suspension of the agreement, or, in the most severe cases, permanent termination of the collaboration. This procedure aims to ensure the maintenance of high service standards and satisfaction for Hearth Card Users.
6.4 Continuous Transparency and Communication:
Hearth S.r.l. commits to maintaining continuous and transparent communication with participating Activities and Users. Any changes to the conditions of discounts or gifts, as well as any issues encountered, will be managed with the utmost clarity and professionalism. Hearth S.r.l. will ensure that all relevant information is promptly available and easily accessible to Users through its official communication channels, including the website, newsletters, and direct communications.
ARTICLE 7: RENEWAL AND TERMINATION OF THE SUBSCRIPTION
7.1 Automatic Renewal of the Subscription:
The Hearth Card subscription automatically renews every year on the anniversary date of its original activation. Users can manage or disable automatic renewal directly from their customer control panel on Hearth S.r.l. at any time. No notice is required to disable automatic renewal, allowing Users complete flexibility in managing their subscription.
7.2 Conditions for Renewal Discounts:
If a User decides to keep automatic renewal active, any discount applied to the subscription at the time of subscription will remain valid for each subsequent renewal, as long as the subscription remains uninterrupted. If the subscription is interrupted and subsequently reactivated, a new promotional code will be required to access any discounts, provided that such promotions are still available at the time of reactivation.
7.3 Refunds:
Hearth S.r.l. does not offer refunds for paid subscription fees, except in exceptional circumstances that will be assessed on an individual basis. To request a refund, it is necessary to send an email to info@hearth.email.
8. DISPUTE RESOLUTION
8.1 Competent Court:
In the event of disputes arising from the interpretation, application, or non-compliance with these Terms and Conditions, including but not limited to issues related to the use of benefits, the validity of the subscription, or the management of deactivation and renewal practices, such disputes will be submitted exclusively to the jurisdiction and competence of the court of Avellino, where the registered office of Hearth S.r.l. is located.
8.2 Resolution Procedure:
Before taking any legal action, the parties involved are encouraged to seek an amicable solution. Hearth S.r.l. is committed to providing assistance and mediating between the parties to resolve any issues quickly and fairly. If the dispute cannot be resolved amicably, the parties may proceed with legal action at the competent court of Avellino.
8.3 Applicable Law:
Disputes will be governed and interpreted according to Italian laws, regardless of conflict of laws principles. Adherence to this agreement indicates that the parties accept the jurisdiction of the aforementioned court as the sole and exclusive forum for resolving any dispute related to the Terms and Conditions.
8.4 Legal Communications:
All communications related to disputes must be sent in writing to the registered office of Hearth S.r.l. or by email to the company's official contacts, ensuring that the documentation is complete and can be adequately filed and considered in the resolution process.
9. ACCEPTANCE AND VALIDITY
9.1 Acceptance Method:
Acceptance of these Terms and Conditions occurs at the time of purchasing the Hearth Card.
9.2 Confirmation of Acceptance:
Once the purchase is completed, the User will receive a confirmation email that includes a copy of the accepted Terms and Conditions, serving as further confirmation of the consent given. This document serves as evidence of the legal agreement between the User and Hearth S.r.l. and can be used as proof of acceptance if necessary.
9.3 Legal Validity of Online Acceptance:
Acceptance of the Terms and Conditions through the online purchase process is considered legally binding and has the same legal value as a handwritten signature. This implies that the User is legally obligated to comply with the stipulated terms when they confirm the purchase of the Hearth Card.
9.4 Review and Updates of the Terms:
Hearth S.r.l. reserves the right to modify the Terms and Conditions at any time. Any changes will be adequately communicated to Users through official channels and will only be effective after a new acceptance by Users. Continuation of the use of the Hearth Card after such changes will constitute acceptance of the new terms by the User.
By accepting these Terms and Conditions, the User declares to have read, understood, and accepted all the clauses indicated herein, committing to comply with them for the entire duration of the Hearth Card subscription.
